Terms of Service

These terms govern your use of GeminiOmni. By creating an account or making a purchase, you agree to them. Read them — they cover what you own, what we don't allow, and how billing works.
1. Account
You need a valid email and you must be at least 13 years old (16 in the EU/UK) to create an account. You are responsible for activity under your account, including any generations charged to your credit balance. Keep your credentials safe — contact [email protected] immediately if you suspect unauthorized access.
2. Acceptable use
You may not use GeminiOmni to generate or distribute: (a) child sexual abuse material (CSAM) or any sexual content involving minors — this is a permanent ban offense; (b) content that depicts real people without consent in sexual or defamatory contexts; (c) malware, phishing pages, or impersonation of others; (d) content that infringes copyright, trademark, or other intellectual property rights of third parties; (e) hate speech, incitement to violence, or harassment campaigns. We hard-block CSAM and bestiality at multiple layers (keyword + text moderation + provider-side policy). Violations result in account termination without refund of credit pack balance.
3. You own your outputs
Generated outputs (images, videos, audio, transcripts) are yours. You receive a non-exclusive, worldwide, royalty-free license to use them for any lawful purpose, including commercial use (ads, products, social media, client work). We do not retain ownership of your outputs and we do not claim shared rights. Caveat: we cannot guarantee that AI-generated content is free of third-party IP claims — use your judgment on derivative cases (recognizable characters, branded products, named real people).
4. Billing and credits
Pricing is credit-based. Subscriptions issue monthly credit allocations; one-time packs add credits to your balance that never expire. Generations consume credits at the rate shown at submission time. Failed generations are auto-refunded to your balance (see Refund Policy §3). All payments are processed by Stripe. Subscription cancellations stop the next renewal but do not retroactively refund the current period (see Refund Policy §1).
5. Upstream AI providers
GeminiOmni routes generations through upstream AI providers (fal.ai, Replicate, kie.ai, DeepSeek, OpenRouter, and others). Each provider has its own content policy that may reject submissions even if our pre-submission moderation passes them. When a provider rejects a submission for content-policy reasons, your credits are not refunded (the cost is real to us). When a provider returns a technical failure (timeout, model error, infrastructure issue), credits are refunded automatically.
6. Service availability
GeminiOmni is provided "as is" without an uptime SLA. We aim for high availability but cannot guarantee uninterrupted service. Planned maintenance is announced in advance when possible. We are not liable for delays, failures, or losses caused by upstream AI provider outages, third-party infrastructure issues, or events outside our reasonable control.
7. Our intellectual property
The GeminiOmni name, logo, website code, UI design, and any documentation we publish remain our property. You may not copy, scrape, or redistribute our site or software without permission. "Gemini", "Veo", "Nano Banana", and other model names are trademarks of their respective owners; we are an independent studio and are not affiliated with Google LLC.
8. Disclaimers and liability
AI-generated content can be inaccurate, biased, or unsuitable for your use case — review outputs before publication. To the maximum extent permitted by law, our total liability for any claim arising from your use of the service is limited to the amount you paid to GeminiOmni in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages.
9. Termination
You can delete your account at any time from your settings. We may suspend or terminate accounts that violate Section 2 (Acceptable use), engage in payment fraud, or abuse the service in ways that harm other users. Terminated accounts forfeit unused credits.
10. Governing law
These terms are governed by the laws of the operator's country of incorporation. Disputes will first be addressed via good-faith negotiation; unresolved disputes go to binding arbitration where permitted by local law. EU consumers retain their statutory rights and may also pursue claims in their local courts.
11. Changes to these terms
Material changes will be announced via in-product notification at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated terms. If you disagree, you can delete your account before the date.
